HyperForms Terms of Service
Last updated: November 7, 2026
These Terms of Service ("Terms") are an agreement between you and ANAVTEK LLC, which operates HyperForms ("HyperForms," "we," "us" or "our"). They cover your use of our website at https://myhyperforms.com and the HyperForms service (together, the "Service").
You accept these Terms when you request access or start using the Service, whichever comes first. If you use the Service for a company or other organization, you confirm that you have authority to accept these Terms for it, and "you" means that organization.
If you have a separate written agreement with us for the Service, such as an order form, that agreement controls where it conflicts with these Terms.
Our Privacy Policy explains how we handle personal information. It is part of these Terms.
The short version
This summary is here to help you. The full Terms below control.
- HyperForms provides web forms for your website. We check each submission for spam and email it to the recipients you choose. We don't keep a copy.
- You decide what your forms ask, and you are responsible for telling the people who fill them out how you will use their information.
- Don't use HyperForms to collect payment card numbers, government ID numbers, passwords or health information.
1. Who can use HyperForms
HyperForms is built for businesses and professionals. You must be at least 18 years old and able to enter into a binding contract to use the Service.
2. What the Service does
HyperForms lets you put a web form on your website without building or hosting it yourself.
- Our team builds your form with the fields and recipients you tell us, and gives you an embed snippet to put on your site.
- When someone submits your form, we check the submission and email it right away to the recipients you chose, with the reply-to address set to the person who filled it out. We don't store submissions. After a submission is emailed, we don't keep a copy, so we can't show it to you or send it again later.
- Some forms accept file uploads: up to 5 files of up to 4 MB in total per submission, in PNG, JPG, WEBP, HEIC or PDF format. Files are sent as email attachments and aren't stored by us. We don't scan files for malware.
- Spam protection is on by default. It uses a hidden honeypot field, timing checks, rate limiting and Cloudflare Turnstile.
- Each form counts how many times it is viewed, so we can see how forms are used. This count doesn't identify anyone (see our Privacy Policy).
3. Working with us
There are no customer accounts or dashboards. To change a form, its fields or its recipients, email us at andrew@hyperdigitalagency.com. Please keep your recipient email addresses correct and up to date.
4. Fees and canceling
Fees. Your fees, billing period and payment terms are those in your order, invoice or other written agreement with us. Prices do not include taxes unless your agreement says they do.
Refunds. Unless your agreement says otherwise, we don't give refunds or credits for partial billing periods or unused time, except where the law requires it. If you think you were charged by mistake, email us at andrew@hyperdigitalagency.com and we'll look into it.
Canceling. To stop using the Service, email us at andrew@hyperdigitalagency.com, and remove the form from your website.
5. Your forms and the people who fill them out
Your notice to form users. You decide what your forms ask and who receives submissions. You are responsible for telling the people who fill out your forms how you will use their information, for example in your own privacy policy, and for getting any consent the law requires.
Sensitive information. Don't use HyperForms to collect payment card numbers, Social Security or other government ID numbers, passwords, or health information.
Email delivery. Submissions are delivered only by email. Email can be delayed, filtered as spam or misdirected, and it isn't a fully secure channel. Because we don't keep copies, a submission that doesn't reach you can't be recovered from us.
File uploads. Files are uploaded by the people who fill out your forms, not by us, and we don't scan them for malware. Be careful when you open them.
Your content and form submissions. Your form settings and the submissions you receive belong to you. You give us permission to process and send them only as needed to run, support and secure the Service.
When people fill out your forms, we process their information on your behalf.
For that information, we act as your service provider. This means:
- we use it only to provide the Service to you, and as needed to keep the Service secure and to comply with the law;
- we don't sell it or share it for advertising, and we don't use it for our own purposes or outside our relationship with you;
- we don't combine it with personal information we get from other sources;
- we keep it confidential, protect it with the same level of privacy protection that the privacy laws that apply to it require, and only let the service providers listed in our Privacy Policy handle it, to help us run the Service;
- you may take reasonable steps to check that we handle it as these Terms say, such as asking us about our practices, and to stop and fix any use that isn't allowed;
- we will tell you if we can no longer meet these commitments; and
- we will help you respond to requests from people about their information, and we will delete the information when you ask or as described in our Privacy Policy.
6. Acceptable use
You may not use the Service:
- to collect passwords or login details, to impersonate another business or person, or for any other kind of phishing;
- to collect information in a deceptive way, or without any notice or consent the law requires;
- to send spam, or to send malware or harmful files;
- to collect the sensitive information described in section 5;
- to break the law or help anyone else break it; or
- in a way that interferes with or overloads the Service, tries to get around its spam protection or limits, or tries to access other customers' forms or our systems without permission.
We may turn off a form, or suspend the Service, if we reasonably believe it is being used in a way that breaks these Terms or creates a risk of harm.
7. Availability and changes to the Service
We work to keep the Service running, but we don't promise that it will always be available, uninterrupted or error-free, and we don't offer a service level agreement unless your written agreement includes one. The Service depends on outside networks and providers, and it may be unavailable at times, for example for maintenance or because of problems with our providers or the internet.
We may change, add or remove features of the Service. If we decide to stop offering the Service entirely, we'll email you at least 30 days before it ends, and we won't charge you for any period after it ends.
8. Suspension and termination
By you. You can stop using the Service at any time by telling us, as described above.
By us. We may suspend or terminate your use of the Service if you don't pay, if you break these Terms, if we reasonably believe your use creates a risk of harm, or if the law requires it. For serious violations, such as fraud, illegal content or abuse of other people, we may act immediately and without advance notice. For other problems, we will usually tell you what's wrong and give you a reasonable chance to fix it first.
9. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
10. Limitation of liability
To the fullest extent the law allows:
- We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or loss of goodwill, even if we were told they were possible.
- Our total liability for all claims relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event that gave rise to the claim, or (b) $100.
Nothing in these Terms limits liability that can't be limited under the law that applies, including liability for our fraud, gross negligence or willful misconduct.
11. Indemnity
To the extent the law allows, you will defend and indemnify us and our owners, employees and agents against any third-party claim, and the losses, damages and reasonable legal fees that result from it, to the extent it arises from your content, your use of the Service, information you collect or send through it, or your breach of these Terms or the law.
12. Disputes, governing law and where cases are heard
Let's try to work it out first. If you have a problem with the Service, please email us at andrew@hyperdigitalagency.com first. If we can't resolve a dispute within 30 days after one of us tells the other about it in writing, either of us may take it to court as described below.
Governing law. These Terms and any dispute about them or the Service are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Where cases are heard. Any lawsuit about these Terms or the Service must be brought in the state courts located in San Bernardino County, California, or in the United States District Court for the Central District of California, and both you and we agree to those courts' jurisdiction. Either of us may instead bring an individual claim in a small claims court that has jurisdiction over it.
13. Changes to these Terms
We may update these Terms from time to time. If we make a change that materially affects your rights, we'll email you at least 30 days before the change takes effect and explain the change. If you keep using the Service after the change takes effect, the updated Terms apply. If you don't agree, you can stop using the Service before the change takes effect. We will always show the date of the latest version at the top of this page.
14. General terms
Notices. We send notices to the email address we have for you. You agree that we may communicate with you electronically, and that electronic notices meet any legal requirement that a notice be in writing. Send notices to us, including legal notices, by email to andrew@hyperdigitalagency.com or by mail to ANAVTEK LLC, 9461 Charleville Blvd PMB 22533, Beverly Hills, CA 90212.
Entire agreement. These Terms, together with our Privacy Policy and any separate written agreement described above, are the entire agreement between you and us about the Service.
Severability. If any part of these Terms can't be enforced, the rest stays in effect, and the unenforceable part will be enforced to the greatest extent the law allows.
No waiver. If we don't enforce a part of these Terms right away, we can still enforce it later.
Assignment. You may not transfer these Terms without our written consent. We may transfer these Terms to a company that acquires our business or the Service.
Events outside our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers or carriers, internet failures, natural disasters or government action.
No third-party beneficiaries. These Terms are between you and us. They don't give rights to anyone else.
